Terms of Service

1. Acceptance of Terms

By downloading, installing, or using StudioShots ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. The App is operated by Constructive Creativity LLC ("we," "our," or "us").

2. Description of Service

StudioShots is a mobile application that allows parents and guardians to upload photos of their children and generate AI-themed versions using various creative themes. The service requires an account and uses a credit-based system for photo generation.

3. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the App.
• The App is designed for parents and legal guardians to use on behalf of their children.
• By uploading photos of a child, you represent that you are the parent or legal guardian of that child and consent to the processing of their image.

4. Account Registration

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• We may suspend or terminate accounts that violate these Terms.

5. Credits and Purchases

• Photo generation requires credits, which can be purchased through Apple's In-App Purchase system.
• Credit purchases are processed by Apple and subject to Apple's terms and refund policies.
• Credits are non-transferable and tied to your account.
• One credit is consumed per photo generation session (producing 2 themed photos).
• If generation fails due to a technical error, your credit will be automatically refunded.
• We reserve the right to modify pricing at any time. Existing purchased credits will not be affected.

6. Acceptable Use

You agree NOT to:

• Upload photos of children for whom you are not the parent or legal guardian.
• Upload inappropriate, offensive, or illegal content.
• Use the App for any unlawful purpose.
• Attempt to circumvent security features or access other users' data.
• Use the App to generate content that could be harmful, exploitative, or inappropriate for children.
• Reverse-engineer, decompile, or modify the App.
• Use automated systems or bots to interact with the App.

7. AI-Generated Content

• Photos are generated using AI technology (Google Gemini). Results may vary and are not guaranteed to match expectations.
• AI safety filters may occasionally block generation for certain photos. This is a safety feature, not a defect.
• You retain ownership of photos you upload. Generated images are licensed to you for personal, non-commercial use.
• We do not claim ownership of your uploaded or generated photos.
• We are not responsible for any unintended alterations AI may make to photos.

8. Intellectual Property

The App, including its design, code, themes, branding, and content (excluding user-uploaded photos), is the property of Constructive Creativity LLC and protected by intellectual property laws. You may not copy, distribute, or create derivative works from the App without our written permission.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the data practices described in the Privacy Policy.

10. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be available at all times or without interruption.
• AI-generated photos will meet your specific expectations.
• The service will be free of errors or defects.

11. Limitation of Liability

To the maximum extent permitted by law, Constructive Creativity LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for credits in the 12 months preceding the claim.

12. Termination

• You may stop using the App and delete your account at any time using the "Delete My Data" feature.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your right to use the App ceases and your data will be deleted in accordance with our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App. Your continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.
